This agreement is made by and between GS Poetry and you (the "User" or "Member" or "Poet"). This agreement contains the terms and conditions that govern your use of this website. Once you become a registered Member, you agree and are bound by the terms and conditions of terms stated on this page.

BY AFFIRMING THAT YOU AGREE WITH THESE TERMS, OR ACCESSING OR USING ANY PART OF THIS WEBSITE, YOU AGREE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THIS AGREEMENT FOR ALL PAST, PRESENT AND FUTURE USES BY YOU OF THE GS POETRY WEBSITE. IF YOU DO NOT AGREE TO BE BOUND BY THIS AGREEMENT, DO NOT ACCESS OR USE ANY PART OF THIS WEBSITE. GS Poetry RESERVES THE RIGHT TO MAKE CHANGES TO THIS AGREEMENT AT ANY TIME. CONTINUED USE OF ANY PART OF THIS WEBSITE CONSTITUTES YOUR ACCEPTANCE OF SUCH CHANGES. ACCORDINGLY, YOU SHOULD REVIEW THIS AGREEMENT FROM TIME TO TIME TO BECOME FAMILIAR WITH SUCH CHANGES.

ANY MEMBER WHO DOES NOT AGREE WITH THESE TERMS CAN REFUSE TO REGISTER OR TERMINATE THEIR ACCOUNT.

USE OF OUR WEBSITE OR SERVICES OR THE PURCHASE OF PRODUCTS AFTER POSTED CHANGES MEANS THAT YOU CONSENT TO THE PRIVACY POLICIES AS CHANGED. ALL TERMS OF THIS AGREEMENT ARE SUBJECT TO CHANGE WITHOUT PRIOR NOTICE.

1. General Rules

1. All users are required to comply with all of the terms and conditions of this agreement.
2. GS Poetry may modify the terms of this agreement at any time with or without prior notice.
3. You must be at least thirteen (13) years of age to view or post content to this site. No one under the age of 13 may register or hold an account, with or without parental permission. We do strive to comply with the Children's Online Privacy Protection Act (COPPA). If you are the parent of a child under the age of thirteen (13) who has created an account using a false birth date, please report it in our support center and we will immediately cancel your child's account and delete all materials associated with your child's account from the site and our database. For more information about COPPA, visit the Federal Trade Commission's website.
4. GS Poetry does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register on GS Poetry or send any information about yourself to us, including your name, address, telephone number, or e-mail address. No one under age 13 may provide any personal information to or on GS Poetry. If we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information immediately. Anyone legally under the age of thirteen (13) who registers on the site is a violator of our Terms of Use. GS Poetry is not liable for any actions taken by violators of our age requirement. If you believe that we might have any information from or about a child under 13, please notify our support team.
5. You agree that any registration information you provide us with will always be accurate, correct, and up to date.

2. Accounts and Security

To become a Member, you need to register with GS Poetry through our online registration form. You can also register with your Google, Facebook or X credentials.

1. Account Information. If you register with your e-mail address, you must complete the form in full to become a GS Poetry Member. If you do not submit a valid e-mail address, your account cannot be verified, in turn your account cannot be created and activated for use. You will be responsible for all use of your password. You must notify GS Poetry immediately if you believe your password has been comprised in any way other than by your actions. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Prohibition on Transfer. You may not share or transfer your account or allow others to use your account. GS Poetry reserves the right to terminate or suspend your account if unauthorized use or suspicious activity is detected.
3. Paid Memberships. Joining and using GS Poetry is free. However, we do have paid memberships that unlock additional features and services. When you use a service that has a fee you have an opportunity to review and accept the fees that you will be charged based on our pricing chart, which may change from time to time. We may choose to change the fees for our services at any time.
4. Fees. All fees are quoted in United States currency. You are responsible for paying all fees and applicable taxes associated with your use of the site.
5. Subscriptions, Automatic Renewal, and Cancellation. Paid memberships are subscriptions that renew automatically at the end of each billing period, and your payment method is charged at each renewal, until you cancel. You can cancel at any time in Settings → Membership; cancellation stops future charges and your paid features continue until the end of the period you already paid for. New accounts begin with a complimentary free week of our paid features that requires no payment method and never charges you automatically; when the free week ends, your account simply returns to the free plan, and you are charged only if you choose to subscribe. Prices are shown at checkout before you confirm any purchase.
6. User Conduct and Compliance. You agree that all information and content you submit complies with all applicable laws and does not infringe any intellectual property or privacy rights. You represent that you are the owner of, or have the necessary licenses or consents for, any data or content you post.
7. Phone Number & SMS Two-Factor Consent. Adding a phone number to your account is optional. If you add one and enable SMS two-factor authentication, you expressly consent to receive automated text messages from GS Poetry containing one-time verification codes for the purpose of securing your sign-in. Message frequency depends on your sign-in activity. Message and data rates may apply according to your mobile carrier's plan; you are responsible for those charges. Consent to receive these messages is not a condition of using GS Poetry, your email address is your primary login, and authenticator-app two-factor is available as an alternative. You may withdraw consent at any time by turning off SMS two-factor or removing your phone number in Settings → Account → Security. SMS two-factor is currently offered only to numbers in the United States and Canada. We do not use your phone number for marketing.

3. Your Conduct

Child Safety (Zero Tolerance). GS Poetry has zero tolerance for child sexual exploitation. You may not upload, post, share, request, solicit, or link to any Child Sexual Abuse Material (CSAM) or any content that sexualizes or endangers a minor. We report all apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) through its CyberTipline, preserve the associated content and account information as required by law, and cooperate fully with law enforcement. Any account involved will be permanently terminated. To report suspected CSAM or child endangerment, use the in-app report tool, email support@gspoetry.com, or reach us through our contact page.

You must use GS Poetry in a manner that demonstrates your individual, original work. Plagiarism is prohibited. If a member is caught with plagiarized work, their Membership will be suspended and/or terminated. PLEASE submit and publish poems that you have written. GS Poetry frowns on the use of artificial intelligence (AI) for poem submissions.

1. Plagiarism is the practice of claiming or implying original authorship of (or incorporating material from) someone else's written or creative work and is prohibited on GS Poetry.
2. No Member may post any copyrighted material unless the copyright is owned by you or you have consent from the owner of the copyrighted material. Spam, flooding, advertisements, chain letters, pyramid schemes, and solicitations are also not allowed on GS Poetry. Any accounts producing or pushing such content will result in immediate account termination.

3. You understand that all information, data, text, software, music, sound, photographs, graphics, artwork, video, messages or other materials ("content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such content originated. This means that you, and not GS Poetry, are entirely responsible for all content that you upload, post, e-mail, transmit or otherwise make available via the site. GS Poetry does not control the content posted via the site and, as such, does not guarantee the accuracy, integrity or quality of such content. You understand that by using the site, you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will GS Poetry be liable in any way for any content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, e-mailed, transmitted or otherwise made available via the site. You agree to not use the site to:

   1. conduct any unlawful purposes or violate any local, state, national, or international law.
   2. upload, post, e-mail, transmit or make available any photos that are unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, pornographic, hateful, or racially, ethnically or otherwise objectionable;
   3. harm minors in any way; impersonate any person or entity, including, but not limited to, a GS Poetry official, forum leader, guide, or falsely state or otherwise misrepresent your affiliation with a person or entity;
   4. upload, post, e-mail, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
   5. upload, post, e-mail, transmit or make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
   6. upload, post, e-mail, transmit or make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
   7. disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;
   8. interfere with or disrupt the site or servers or networks connected to the site, or disobey any requirements, procedures, policies or regulations of networks connected to the site;
   9. intentionally or unintentionally violate any applicable local, state, national or international law;
   10. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
   11. "stalk" or harass another; or
   12. collect or store personal data about other users.
   13. alter or modify another website to falsely imply association with GS Poetry.
   14. gain unauthorized access to the website's systems, accounts of other users, or networks; reverse engineering, decompiling, or hacking any part of the website.
   15. Leasing, selling, copying, sublicensing, transferring, or assigning any information or services provided on the website; violating copyrights, trademarks, privacy, or other rights of GS Poetry or third parties.

You acknowledge that GS Poetry may or may not pre-screen content, but that GS Poetry and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any content that is available via the site. Without limiting the foregoing, GS Poetry and its designees shall have the right to remove any content that violates the TOU or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. In this regard, you acknowledge that you may not rely on any content created by GS Poetry or submitted to GS Poetry, including without limitation information in GS Poetry Message Boards, and in all other parts of the site.

You acknowledge, consent and agree that GS Poetry may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Use; (c) respond to claims that any content violates the rights of third parties or other claims of abuse; (d) respond to your requests for customer site; or (e) protect the rights, property, or personal safety of GS Poetry, its users and the public.

You understand that the technical processing and transmission of the site, including your content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

You understand that the site and software embodied within the site may include security components that permit digital materials to be protected, and use of these materials is subject to usage rules set by GS Poetry and/or content providers who provide content to the site. You may not attempt to override or circumvent any of the usage rules embedded into the site. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the site, in whole or in part, is strictly prohibited.

You may not use the Services to mine data from the GS Poetry database or any User Content, whether automatically (including using so-called software robots) or manually. You may not access, tamper with, or use non-public areas of the Services, our computer systems, or the technical delivery systems of our providers.

Although GS Poetry cannot constantly monitor the conduct of its Members on the website, it is also a violation of these rules to use any information obtained from the site in order to harass, abuse, or harm another person, or in order to advertise to, solicit, or sell to any Member without their prior written consent.

You are solely responsible for your interactions with other GS Poetry Members. GS Poetry reserves the right, but has no obligation, to monitor disputes between you and other Members.

4. User Content

1. Ownership. You retain ownership of any poems, comments, images, or other materials ("User Content") you post on the Site. GS Poetry does not claim ownership over your original works.
2. License to GS Poetry. By posting User Content, you grant GS Poetry a non exclusive, worldwide, royalty free, sublicensable, and transferable license to use, reproduce, distribute, adapt, display, and perform your User Content in connection with operating and promoting the Site. This license ends when you remove your User Content from the Site or terminate your account, except that archived copies may remain as part of routine backups.
3. User Responsibilities. You represent and warrant that (a) you have the rights necessary to grant the license above; (b) your User Content will not violate any third party rights, including copyright, privacy, or publicity rights; and (c) your User Content is not unlawful, defamatory, obscene, harassing, hateful, or otherwise inappropriate.
4. Removal of Content. GS Poetry reserves the right, but not the obligation, to remove or disable any User Content that violates these Terms or is otherwise objectionable. We may also suspend or terminate your account for such violations.
5. Acknowledgement. You understand that by using the Services on GS Poetry you may be exposed to content that you may find offensive, indecent, sexually explicit or objectionable and that, in this respect, you use the Services at your own risk. You also acknowledge and agree that GS Poetry is not liable for any content uploaded by you.
6. Members are not permitted to collect or store personal data about other users. Additionally, you cannot solicit personally identifiable information from other members or disclose another member's identity without their written permission.
7. There is no promise, no guarantee, and no warranty that poems will be continually available or that your works will be stored indefinitely. Members are advised to store their works elsewhere as a means of a reliable backup and not to depend on GS Poetry for storage.

5. Terms of Uploads and Linkage

Any image or file uploaded to the GS Poetry servers are subject to review and we reserve the right to accept or reject any file uploaded to GS Poetry servers at any time.

1. You acknowledge that GS Poetry may or may not pre-screen content. GS Poetry and the submitter has the right to remove an image or file from its servers at any time for any reason. If the submitter requests removal of any file, they must reach out to our support team.
2. Members are not allowed to link to any file to use as a background image for their profile without consent from the file owner. If a Member links a background image that is not their own and has not gotten permission to do so, that may result in the Member's profile to be suspended or terminated.
3. No Endorsement. The website may contain links to third party websites or services. These links are provided for convenience only. GS Poetry does not endorse or control these third parties and is not responsible for their content, policies, or practices.
4. Use at Your Own Risk. Your use of third party sites or services is at your own risk. Any transactions or interactions with third parties are solely between you and the third-party.

If you submit content to GS Poetry (on a message board, in connection with your participation in a GS Poetry contest, or otherwise) you hereby grant GS Poetry an unrestricted and unlimited license to use such content (or any portion thereof) on the GS Poetry website, in e-mail "newsletters" or other promotional materials (collectively referred to as "Promotions") to promote or advertise GS Poetry.

5. Sexually explicit photos/graphics will not be allowed on GS Poetry. If you choose to post sexually explicit photos, YOUR PROFILE WILL BE SUSPENDED OR TERMINATED. If you currently have pictures that are sexually explicit, YOUR PROFILE WILL BE SUSPENDED OR TERMINATED.

   1. Female: Sexually explicit photos/graphics include but are not limited to showing breasts without a bra, showing nipples, most of your body being uncovered, showing your backside with or without a thong, most of the backside is uncovered, your vagina, and your pubic hair.
   2. Male: Sexually explicit photos/graphics include but are not limited to showing your pubic hair, penis, testicles, most of your body being uncovered, most of the backside being uncovered.
   3. Other: You cannot post photos, graphics or animations of sex acts that include but are not limited to sexual intercourse between any gender or animal and oral sex.
6. Poems submitted to GS Poetry will remain in our database unless a user specifically instructs GS Poetry to remove the poems. Deleting your profile does not delete your poems from the database or the site.

6. Disclaimer of Warranties and Service Interruptions

The GS Poetry website and its services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. GS Poetry disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non infringement, to the fullest extent permitted by law.

1. Each party represents and warrants to the other party (i) that it has the full power and authority to enter into and perform under this agreement, (ii) the execution and performance by it of its obligations under this agreement do not constitute a breach of or conflict with any other agreement or arrangement by which it is bound, or any applicable laws, regulations or rules, and (iii) this agreement is a legal, valid and binding obligation of the party executing this agreement, enforceable in accordance with its terms and conditions.
2. Representation. You represent and warrant to GS Poetry that any content you submit to GS Poetry will not infringe the copyright, trademark, patent, trade secret, rights of privacy and publicity or other legal right of any third-party.
3. No Warranty for User Content. We do not warrant the accuracy, completeness, or usefulness of any User Content, nor do we endorse any opinions expressed on the website through poems, messages, threads, comments or any other written and spoken (video) channel. You rely on User Content at your own risk.
4. Service Interruptions. GS Poetry may temporarily suspend the Site for maintenance or other purposes, and unintentional outages may occur. We will make reasonable efforts to notify users of scheduled interruptions, but we do not guarantee continuous, uninterrupted access to the website.

7. Disclaimers, Exclusions and Limitations of Liability

GS Poetry provides itself on an "as is" basis. GS Poetry does not represent or warrant that GS Poetry or its use (i) will be uninterrupted, (ii) will be free of inaccuracies or errors, (iii) will meet your requirements, or (iv) will operate in the configuration or with the hardware or software you use. GS Poetry makes no warranties other than those made expressly in this agreement, and hereby disclaims any and all implied warranties, including without limitation, warranties of fitness for a particular purpose, merchantability and non-infringement.

The third-party links, services, resources and information that GS Poetry provides on or makes available through the GS Poetry website are not controlled by GS Poetry. Accordingly, GS Poetry makes no warranties regarding such third-party services, resources and information, including without limitation, warranties of fitness for a particular purpose, merchantability and non-infringement and will not be liable for your use of or reliance on such third-party services, resources or information.

GS Poetry will not be liable to you or any third-party for any consequential, incidental, indirect, punitive or special damages arising out of, relating to or connected with the use of the uploaded content, based on any cause of action, even if advised of the possibility of such damages.

When a user submits a suggestion to the Ideabox, they do so with the understanding that this is a voluntary act and there is no financial or monetary gain, past, present or future, if their suggestion is implemented on gspoetry.com or its associated domains. By submitting a suggestion, the user has agreed and accepted to the terms of this disclaimer. User submitted suggestions are intended to make the poetry experience better for the user submitting the suggestion.

No Indirect Damages. To the maximum extent permitted by law, in no event shall GS Poetry, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site. This includes damages for lost profits, lost data, personal injury, or emotional distress, even if we have been advised of the possibility of such damages.

Cap on Liability. To the fullest extent permitted by law, GS Poetry's total liability for any claims arising from or related to the Site shall not exceed the greater of (a) the amount you paid, if any, for access to the website during the twelve months preceding the claim, or (b) one hundred U.S. dollars (US$100).

8. Indemnification

You agree to defend, indemnify, and hold harmless GS Poetry, its officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected to (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third party rights, including intellectual property, privacy, or publicity rights; or (d) your User Content.

9. Termination

Right to Terminate. GS Poetry may, at its sole discretion, suspend or terminate your account and access to the Site at any time, with or without notice, for any reason, including violation of these Terms or applicable laws.

Effect of Termination. Upon termination, your right to use the Site will immediately cease. Provisions that by their nature should survive termination will remain in effect, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitation of liability.

We reserve the right to permanently store, maintain, use and display all images uploaded by you in the past, even if you terminate your Membership. Please note that Membership termination will not necessarily result in your information being purged/terminated from GS Poetry databases; just that you will no longer be able to access GS Pro features on GS Poetry. We will delete all information for a Member at their request. This agreement will survive indefinitely unless and until GS Poetry chooses to terminate it, regardless of whether any account you open is terminated by you or GS Poetry.

If you, the User, terminate your Membership and want your poems completely removed from our database, you must submit a request to our support team. Don't forget that all users can download all of their data themselves before closing their account.

10. Prohibited Activities & Automated Access

10.1 Automated Access and Scraping Restrictions

You agree that you will NOT use, and will not permit any third party to use, any automated means to access the Service, including but not limited to:

1. Robots, spiders, scrapers, crawlers, or any other automated devices, programs, tools, algorithms, code, processes, or methodologies to access, acquire, copy, or monitor any portion of the Service, any data or content found on or accessed through the Service, or any other Service functionality;
2. Any automated system that sends more request messages to our servers in a given period of time than a human could reasonably produce in the same period using a conventional web browser;
3. Scripts, bots, or automated programs designed to create accounts, post content, or perform any other actions on the Service without express written permission from us;
4. Web crawlers, web robots, web scutters, ants, automatic indexers, or similar devices to systematically retrieve data or content from the Service;
5. Any manual process to monitor or copy any content, data, or material on the Service or for any unauthorized purpose without our prior written consent;
6. "Offline readers," "cache programs," or similar tools that access the Service in a manner that sends more request messages than a human user actively reading content would normally generate.

Limited Exception: Notwithstanding the foregoing, we grant the operators of public search engines permission to use spiders to copy materials from the Service for the sole purpose of, and solely to the extent necessary for, creating publicly available searchable indices of the materials (but not caches or archives of such materials). We reserve the right to revoke this exception either generally or in specific cases at any time, with or without notice.

10.2 Unauthorized Data Collection and Use

You agree that you will NOT:

1. Collect, harvest, mine, or extract any data or content from the Service, including but not limited to user information, email addresses, usernames, poems, stories, comments, or any other user-generated content, through any automated or manual means;
2. Use any information obtained from the Service to contact, advertise to, solicit, or sell to any user without their explicit prior consent;
3. Aggregate, copy, duplicate, or create derivative databases from any data or content available through the Service;
4. Access the Service for the purpose of building a similar or competitive service, product, or platform;
5. Use any data or content from the Service for any commercial purpose not expressly permitted by these Terms, including but not limited to creating compilations, databases, or directories;
6. Employ any data mining, data harvesting, data extracting, or any other similar data gathering or extraction methods in connection with the Service.

10.3 Account Security and Credential Sharing

You agree that you will NOT:

1. Share your account credentials (username and password) with any third party for any reason, including with services claiming to import, export, backup, or migrate your content;
2. Allow any third-party service or application to access your account using your login credentials;
3. Create multiple accounts for the same individual or entity, or use another person's account, or allow others to use your account;
4. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person, group, or entity;
5. Attempt to gain unauthorized access to any other user's account, the Service's computer systems, or networks connected to the Service through hacking, password mining, or any other means.

You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

10.4 System Interference and Abuse

You agree that you will NOT:

1. Interfere with, disrupt, or create an undue burden on the Service, its servers, networks, or any systems or resources connected to the Service;
2. Take any action that imposes an unreasonable or disproportionately large load on our infrastructure, as determined by us in our sole discretion;
3. Attempt to bypass, circumvent, or disable any security features, access controls, or usage limits of the Service, including any measures we have implemented to prevent or restrict access to the Service;
4. Probe, scan, or test the vulnerability of the Service or any network connected to the Service, or breach any security or authentication measures;
5. Reverse engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code for any underlying software, intellectual property, or algorithms of the Service;
6. Use the Service's communication systems (such as comments, messaging, or email features) for commercial solicitation, spamming, or any unauthorized bulk communications;
7. Engage in "flooding," "spamming," "trolling," or any other behavior designed to disrupt the normal operation of the Service or other users' experience.

10.5 Third-Party Tools and Services

You agree that you will NOT:

1. Use any third-party tools, services, software, or browser extensions designed to automate interactions with the Service, scrape content, or otherwise access the Service in violation of these Terms;
2. Develop, distribute, or promote any tools, services, or applications designed to violate these Terms or facilitate violations by others;
3. Frame, mirror, or otherwise incorporate any portion of the Service into any other website, application, or service without our express written permission.

10.6 Intellectual Property Protection

You agree that you will NOT:

1. Copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content from the Service for any commercial or non-commercial purposes without the express written consent of the content owner and us;
2. Modify, create derivative works of, translate, reverse engineer, decompile, or disassemble any portion of the Service or its content;
3. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in or on the Service or any content accessed through the Service;
4. Use our trademarks, logos, domain names, or other distinctive brand features without our prior written permission.

10.7 Commercial Use Restrictions

The Service is provided for personal, non-commercial use only, except as expressly authorized by these Terms. Without our express written approval, you agree that you will NOT:

We may access, preserve, and disclose your account information and content if required to do so by law or if we believe in good faith that such action is necessary to: (a) comply with legal process or governmental requests; (b) enforce these Terms; (c) respond to claims that any content violates the rights of third parties; (d) detect, prevent, or address fraud, security, or technical issues; or (e) protect the rights, property, or safety of our company, our users, or the public.

10.10 Consequences of Violations

Violation of any provision in this section may result in, without limitation:

1. Immediate termination or suspension of your account and access to the Service, with or without notice;
2. Removal of any content you have posted or submitted;
3. IP address blocking or other technical measures to prevent further access;
4. Legal action, including seeking injunctive relief and monetary damages;
5. Reporting of your activities to appropriate law enforcement authorities;
6. Recovery of our attorneys' fees and costs if we take legal action against you.

We reserve the right to pursue any and all legal remedies available to us under applicable law for violations of these Terms.

10.11 Reporting Violations

If you become aware of any violations of these Terms, including unauthorized scraping, automated access, or misuse of the Service, please report them to us immediately at support@gspoetry.com. We take all reports seriously and will investigate and take appropriate action.

10.12 Changes to These Restrictions

We reserve the right to modify, update, or change these restrictions at any time. Your continued use of the Service following any such modifications constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically to stay informed of any changes.

11. Reporting Abuse

To maintain the integrity of the site, Members can report abuse by other Members to GS Support. Members can report abuse against other Members for the following: harassment, excessive and persistent use of profanity, stalking, or any Member conducting themselves in a manner that is detrimental are harmful to community. Prolonged misbehavior and complaints made by Members will result in the accused Member's profile to be suspended or terminated.

GS Poetry investigates all reported abuse claims. The outcome of each investigation will be made on a case-by-case basis and will depend on the amount of information sent to us that displays a pattern of behavior. Results of investigations can yield warnings, suspended accounts, terminated accounts and more if applicable by law.

We reserve the right to change, remove or add stipulations accordingly without notice.

GS Poetry has full authority to terminate and suspend accounts at any time for any reason. If we feel that a Member is purposely abusing the system and others, their profile will get suspended and/or terminated.

12. Trademark Information

"GS Poetry" and any other names, logos, or trademarks appearing on the Site are the property of their respective owners. You may not use these marks without prior written consent. Merchandise bearing the GS Poetry logo grants the purchaser to use, wear and display the GS Poetry logo. It does not grant the purchaser, or anyone else, to duplicate and distribute the logo for profit or non-profit. Further, you acknowledge and agree that content contained in sponsor advertisements or information presented to you through the website or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. You agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the site.

13. Miscellaneous

1. Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
2. Entire Agreement. These Terms constitute the entire agreement between you and GS Poetry regarding the Site and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, related to the subject matter hereof.
3. No Waiver. The failure of GS Poetry to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
4. Assignment. You may not assign these Terms or any rights or obligations herein without GS Poetry's prior written consent. GS Poetry may assign these Terms without restriction.

By using the GS Poetry community website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

14. Copyright and Intellectual Property Rights

Except for User Content, all content on the Site (including text, graphics, logos, software, and design elements) is owned by GS Poetry or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works from Site content without our express written permission.

GS Poetry respects the Intellectual Property (IP) owned by our members if the member is the original author/creator of said work. GS Poetry may, in appropriate circumstances and at its discretion, suspend and/or terminate the accounts of users who plagiarize works of poetry. If a Member believes that their work has been plagiarized in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please read the information below.

How to claim a copyright infringement:

Our full notice-and-takedown process — including how to file a counter-notice and our repeat-infringer policy — is on the DMCA Copyright Policy page. In summary, pursuant to 17 U.S.C. 512(c)(3), a notification of claimed copyright infringement on the "GS Poetry" website should be sent to our Designated Agent (see the DMCA policy) and needs to include the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
2. Identification of the copyrighted work(s) claimed to have been infringed.
3. Identification of the material claimed to infringe the copyright(s), reasonably sufficient to enable "GS Poetry" to locate the material in order to remove the material or suspend access.
4. Information reasonably sufficient to allow "GS Poetry" to contact the complaining party (including name, address, phone number, and e-mail address)
5. Statement that the complaining Claimant has a "good faith belief that use of the material in the manner complained of is not authorized by the copyright (holder), its agent or the law."

UNDER FEDERAL LAW, IF YOU KNOWINGLY MISREPRESENT THAT ONLINE MATERIAL IS INFRINGING, YOU MAY BE SUBJECT TO CIVIL PENALTIES, INCLUDING MONETARY DAMAGES, COURT COSTS, AND ATTORNEY'S FEES INCURRED BY GS POETRY, OR BY ANY COPYRIGHT OWNER'S LICENSEE THAT IS INJURED AS A RESULT OR A MISREPRESENTATION. IN ADDITION, YOU MAY ALSO BE SUBJECT TO CRIMINAL CHARGES FOR PERJURY, IN ACCORDANCE WITH APPLICABLE LAW. GS POETRY PROSECUTES TO THE FULL EXTENT ALLOWABLE BY LAW.
